New Delhi: The Supreme Court on Tuesday issued notice to the Enforcement Directorate seeking its response on Delhi minister Satyendar Jain’s appeal challenging the transfer of the PMLA case against him to another judge in the trial court which was done on the agency’s plea.

Agreeing to hear his plea, a bench of Justices MR Shah and Krishna Murari asked ED to file a response by October 19 and posted the case for hearing to October 31. Jain approached the apex court after his plea against the transfer of his case was rejected by Delhi High Court. The High Court on October 1 had held that the principal district and sessions judge while transferring the case, had considered all facts and said that it could not be held that the decision suffered from any illegality or needed interference.

On September 23, principal district and sessions judge ( Rouse Avenue Courts ) Vinay Kumar Gupta allowed the Enforcement Directorate’s transfer petition in the case. The case was transferred from the court of special judge Geetanjali Goel to that of special judge Vikas Dhull. The agency, in its transfer application before the district judge, had argued that while there was no complaint against the judge hearing the matter, it was ” a case of probable bias ” in favor of the Delhi minister and there was an apprehension that it might not get an independent and impartial hearing.
