New Delhi : Supreme Court judge Justice K M Joseph , who had authored the verdict for put ting in place new mechanism for appointment of the Chief Election Commissioner and Election Commissioners by a panel comprising the Prime Minister , Chief Justice of India and Leader of Opposition of Lok Sabha , recused from hearing a plea seeking quashing of appointment of Election Commissioner Arun Goal .
But before recusal , the bench , also com prising Justice B V Nagarathna , asked how the appointment of Goal could be quashed on the basis of the judgement which was deliver dafter the government appointed him . It asked the petitioner to point out the law which was violated .

Advocate Prashant Bhushan , appearing for petitioner Association for Democratic Re forms , contended that Goal was appointed arbitrarily and in haste by the Centre which should be questioned on why only four bureaucrats were shortlisted .
” There were many other senior officers from the same batch and we have given the list of those and all were eligible . But why only four names were plucked out and the entire process was concluded in a day , ” Bhushan submitted .
Justice Nagarathna , however , said there was no stay on appointment when the hearing was going on in court . ” You may say that it was done in a tearing hurry , undue haste but show us violation of rule . There was a system pre vailing at that time . You cannot rely on our judgement . It was delivered after his appoint mint , ” the bench observed .
