Patna : A Patna court on Wednesday summoned Congress functionary Rahul Gandhi ( Raga ) again to appear before it on April 25 in a defamation suit filed by BJP’s Rajya Sabha member Sushil Modi ( Summon ) over his purported ” defamatory ” remark on Modi surname .
Earlier on March 18 , the court of special judge Aadi Dev had asked Rahul to appear before it on April 12. But his counsel sought another date on the plea that the entire legal team of Rahul was busy with the Surat case ( over the same issue ) , in which he was currently sentenced to two years ‘ imprisonment , leading to his dis qualification from the Lok Sabha .
Accepting the argument , the judge asked his counsel to ensure his ( Rahul’s ) physical appearance before the court on April 25 .
Prosecution lawyer Priya Gup ta told reporters outside the court room that the statements from
the complainant’s side had been recorded and all evidences had al ready been submitted to the court .
Now , only the statement of Rahul is to be recorded under relevant Carps sections . Earlier , Sum’s counsel SD Sanjay opposed the petition by Rahul’s lawyer and urged the court to issue a warrant of arrest against the Congress pol Italian to ensure his physical presence in the court .
Sum filed the defamation case in April , 2019 , accusing Rahul of defaming the Modi community at a rally in Karnataka’s Kolar in the run – up to that year’s Lok Sab ha elections . ” How come all the thieves have Modi as the common surname , ” Rahul was quoted .
