Dehradun : A division bench of the Uttarakhand high court has ordered an Army man, Ganesh Singh Gadiya, 31, to pay his ailing wife Rs 15,000 per month. Gadiya had managed to get an ex – parte divorce from a family court in the Haldwani district. His wife, Jyoti Gadiya, 24, had approached the high court, saying she couldn’t make her case at the family court due to her ailments. The court on Wednesday also revoked the ex – parte divorce.
Jyoti and Ganesh got married on February 18, 2019. According to Ganesh’s counsel, since the Army man was posted on the border and his wife was staying with her in-laws, the couple had developed some misunderstanding. Following this, Ganesh 2020 approached the family court for a divorce decree on the ground of cruelty under section 13 ( 1 ) ( IA ) of the Hindu Marriage Act.
Jyoti said that she was suffering from various ailments including migraine, which prevented her from participating in the proceedings. She has filed her medical record to substantiate her claim.
The HC also ordered the Army man to pay litigation expenses of Rs 15,000 to his wife within four weeks and to also pay ad – hoc maintenance of Rs 15,000 per month to her.
