Nainital: The Uttarak hand high court on Thurs day quashed a single judge bench order to reinstate employees dismissed from the state assembly secretariat while upholding the order of assembly speaker Khanduri Bhushan.
A division bench of Chief Justice Vipin Sang hi and Justice RC Khulbe passed the order while hearing a special appeal filed by the assembly secretariat challenging the single bench order.
After hearing the case, the court said the termination order cannot stay. Acting on recommendations of an expert committee, Khanduri on September 23 revoked 228 ad – hoc appointments made in the assembly secretariat allegedly through the ” back door “. However, the high court on October 15 stayed the order after some of the dismissed employees challenged Khan Durai’s decision.
Terming Thursday’s court order as a ” win for justice “, Khanduri said: ” We had approached the double bench of the high court against the single bench order to stay the termination of ad – hoc employees and the double bench has vacated the stay order: ” ” This is a win for justice. My decision was in favor of the state assembly and its dignity. As I have said earlier, I will not back out from taking tough decisions, which are in favor of the youth of the state. Therefore, we approached the double bench of the HC. “
The speaker added that her decision to terminate the ad – hoc employees were ” not against any individual.
