Dehradun : The district consumer commission of Haridwar ordered a dealer of Apple iPhone to pay the total insured amount to a complainant whose mobile phone that was purchased in an exchange offer was damaged. The court also ordered the dealer to pay Rs 20,000 as compensation for mental harassment and litigation charges.
Rahul Mittal, a resident of Subhash Nagar in Haridwar district stated in his appeal that he had purchased iPhone from a prime shop in Govindpuri on April 26, 2021, for Rs 59,900 and got his phone insured for a year from Bajaj Finance by paying a premium of Rs 5,339.
After a few months, the handset got damaged in October. Mittal asked the dealer whether he should give him a new handset or refund the sum insured, but he was denied stating that the insurance was on Mittal’s old handset which was swiped with the new one.
After hearing arguments from both sides, the consumer court said that it is a matter of deficiency of services on the part of the mobile dealer as well as the finance company and ordered them to return the handset amount to the consumer within 30 days. The court also ordered them to pay Rs 10,000 as compensation for mental harassment and Rs 10,000 for legal fees. Besides, consumer Mittal is also asked to return the damaged handset to the phone dealer.
